• Payment processing is handled by third-party providers under their own terms and privacy notices.

4. Activation and Service Use

• Your device must be eSIM-compatible, carrier-unlocked, and configured correctly.
• Activation timing, plan start, and expiration follow the product terms shown during purchase.
• Some plans may be data-only and may not include voice, SMS, or emergency calling features.

5. Coverage, Speed, and Availability

Coverage and network speed depend on local partner networks, device capabilities, location, congestion, and other factors outside our direct control. We do not guarantee uninterrupted service in every location.

6. Refunds and Cancellations

• Because eSIM plans are digital services, cancellation rights may be limited once activation begins.
• Where local law grants mandatory withdrawal or refund rights, those rights remain unaffected.
• If a plan cannot be provided due to a verified technical issue, contact support for review.

7. Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes:

• Unlawful activity, fraud, abuse, or attempts to bypass security controls
• Using the Services to distribute malware, spam, or infringing content
• Reselling, cloning, or manipulating plans in ways not authorized by us
• Any use that harms the network, other users, or our partners

8. Intellectual Property

All trademarks, branding, software, text, and design elements in the Services are owned by Roaming eSIM or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Services for personal or internal business use, subject to these Terms.

9. Third-Party Services

The Services may integrate with third-party app stores, payment providers, telecom operators, or external links. We are not responsible for third-party content, policies, or availability.

10. Suspension and Termination

We may suspend or terminate access if you breach these Terms, engage in fraud, or create legal/security risk. We may also discontinue specific plans where required by partners, regulators, or technical constraints.

11. Disclaimers

Except as required by law, Services are provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, Roaming eSIM is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption. Our aggregate liability for claims relating to the Services is limited to the amount paid by you for the affected service in the 12 months before the claim arose.

13. Indemnity

You agree to defend and indemnify Roaming eSIM against third-party claims, liabilities, losses, and expenses arising from your unlawful use of the Services or breach of these Terms, except to the extent caused by our own negligence or willful misconduct.

14. Governing Law and Disputes

Unless mandatory local consumer law states otherwise, these Terms are governed by the laws of the country where Roaming eSIM is legally established, and disputes are subject to the non-exclusive jurisdiction of the competent courts in that country.

15. Regional Consumer Rights

• If you are a consumer in the EU/EEA or UK, mandatory consumer protections in your home country still apply.
• If local law grants additional non-waivable rights, these Terms do not limit those rights.
• Nothing in these Terms excludes liability where exclusion is not allowed by law.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated date and, where required, additional notice will be provided through the Services.
