Kenya travel insurance rule suspended: eTA guide for 2026

Kenya's High Court has temporarily stopped the government from demanding the new mandatory visitor health insurance announced in July 2026. The order pauses enforcement while the court hears the challenge. It does not erase the insurance language already present in Kenya's Social Health Insurance Act and regulations.

The practical position on August 30 is simpler than many search results suggest. Kenya's official eTA portal does not list travel insurance among its current application documents. It does list passport, photo, contact, itinerary, accommodation and payment requirements for travelers who need an eTA. Buy travel insurance because it fits the risks of the trip, not because an unofficial site says you must purchase a particular Kenya policy today.

The traveler decision: check whether your passport is exempt on the official eTA list. If you need an eTA, apply through the government portal and use the documents it currently requests. Keep suitable insurance for medical and trip protection, but do not pay a supposed mandatory Kenya insurance charge unless an official source confirms that enforcement has resumed.

This guide was checked on August 30, 2026. The court process and portal can change quickly. Recheck both before departure, especially after the next reported court date on September 16.

Kenya entry status at a glance

What the High Court paused

Kenya published Gazette Notice No. 11492 at the end of July. Reports on the notice described a mandatory policy for non-Kenyan visitors staying under 12 months, with total minimum benefits of USD 50,000. The framework drew immediate questions about approved insurers, foreign policies, data handling, public participation and how a traveler would prove cover.

On August 24, The Standard reported that Justice Francis Rayola had blocked the government from demanding the cover while a challenge proceeds. The case argues that the Health Ministry tried to direct an immigration function without a workable implementation mechanism. A separate report on the order gives September 16 as the next hearing date.

That is a temporary court position, not a final judgment on the whole policy. A headline saying the rule is "cancelled" goes too far. A page saying every visitor must buy USD 50,000 of approved cover before boarding is also out of date while enforcement is paused.

The policy history matters here. A Ministry of Health implementation document published before the new notice said an earlier implementation process was already held up by litigation. That is another reason to check the live portal instead of assuming that a statutory provision has become a working airport process.

What remains in Kenyan law

The court order did not delete the legislation behind the policy. Section 26(6) of the Social Health Insurance Act says a non-Kenyan intending to remain for less than 12 months must possess travel health insurance as designated by the Cabinet Secretary.

Regulation 70 says the cover should last for the full stay and include accident, emergency medical expenses, evacuation, repatriation, hospital benefits and prescription medicines. It also says cover may be obtained at the point of entry.

Those provisions explain why the issue can return after the court process or a revised implementation notice. They do not answer today's operational questions by themselves. Travelers still need to know whether enforcement is active, which policy qualifies, how proof is submitted and what an airline checks before boarding. On August 30, the official eTA pages do not provide that insurance workflow.

What the official eTA portal requires now

Kenya's official application guide currently lists:

• a passport valid for at least six months with a blank page;
• a selfie or passport-style photograph;
• email and phone details;
• arrival and departure information;
• accommodation confirmation; and
• a credit card, debit card or another accepted payment method.

Extra documents depend on the purpose of travel. Business, conference, medical and family visits have their own supporting records. The page does not list proof of travel insurance among the general required documents.

The official eTA FAQ says normal applications start at USD 30 and are generally processed within three business days. The general information page recommends applying at least two weeks before travel because verification can take longer. Use the longer planning window. A three-day usual result is not a guarantee.

Only the government portal or its named official mobile application should receive the application. Save the approval PDF on the phone and as a second offline copy. An eTA is permission to travel, not final admission; immigration makes the entry decision at the border.

Do all African travelers now enter without an eTA?

Do not rely on a blanket "all Africans are exempt" headline. Kenya's live list is more specific.

The official page gives East African Partner State citizens a stay of up to 180 days without an eTA. It also lists one group of nationalities with stays up to 90 days and another group of African nationalities with stays up to 60 days. Libya and Somalia do not appear in that 60-day group. Permanent residents, valid permit holders, certain transit passengers and named official-document holders have separate exemptions.

Open the current exemption list and find the passport country by name. The permitted length is part of the answer. A Cabinet announcement, older embassy page or search snippet is not a substitute for the live operational list used by the eTA service.

Children, groups and family applications

The portal says infants and children need an approved eTA before travel when they are not exempt. A family can start a group application, but each passenger still has an individual travel authorization.

Check every child's passport validity and upload the requested image and travel details. Carry any consent, custody or relationship documents required by the family's circumstances and departure country. The eTA portal's standard document list does not settle those separate child-travel rules.

Families planning the route itself can use Kenya with kids.

Leaving for Tanzania and returning to Kenya

One traveler reported a successful return at Namanga, but one border experience is not a rule for every passport, date and approval.

The public eTA FAQ checked for this article does not give a universal re-entry answer. Before leaving Kenya, send the exact passport nationality, eTA reference, validity dates, exit point and planned return point to the support contact published on the official portal. Save the reply. If the service says a new authorization is needed, apply before attempting the return journey.

This caution is worth the inconvenience. An airline boarding decision and a land-border admission decision can depend on the actual authorization record, not a screenshot of somebody else's trip.

Should you still buy travel insurance?

The court suspension answers whether the new government notice can be demanded right now. It does not pay a hospital, ambulance, evacuation flight, missed connection or cancelled safari.

Choose insurance by the trip you are taking. A city break, road safari, light-aircraft transfer, high-altitude hike and Indian Ocean boat trip expose the traveler to different costs and exclusions. Check:

• emergency medical and evacuation limits;
• pre-existing-condition rules;
• safari, hiking, diving or other activity exclusions;
• cancellation and interruption cover;
• baggage and device limits;
• assistance contact methods; and
• exclusions linked to official travel warnings.

The UK travel advice for Kenya is one example of a government source that recommends appropriate insurance and warns that cover can be affected by travel against official advice. Travelers should use guidance issued for their own nationality and residence.

Keep the certificate and assistance number offline even though the current eTA list does not request an upload. That document is useful during a medical problem and leaves the traveler prepared if Kenya publishes a lawful revised process before departure.

A pre-departure check that avoids stale advice

Run these checks in order within the week before travel:

1. Open the official eTA exemption list and confirm the passport category.
2. If an eTA is required, confirm approval rather than relying on a payment receipt.
3. Check whether the portal has added an insurance field or a new notice.
4. Look for an update to the court case after September 16.
5. Confirm airline, airport and land-border requirements for the actual route.
6. Save the eTA approval, bookings, insurance certificate and support contacts offline.
7. Keep a payment fallback, but do not buy a policy from an unsolicited link at the airport or in a message.

If the official portal and a news article disagree, the portal and the controlling court or legal notice deserve the next check. Search results can retain a confident answer after its effective date or enforcement status has changed.

Where Roaming eSIM fits into a Kenya arrival

1. Does Kenya require mandatory travel insurance now?

The July 2026 enforcement notice is suspended by a High Court order while the challenge proceeds. Recheck the official portal and court status before travel.

2. Has Kenya cancelled the visitor-insurance law?

No. The Act and regulation still contain travel-insurance provisions. The current court order pauses the challenged enforcement process; it is not a repeal.

3. Do I need USD 50,000 of cover to board a flight today?

The USD 50,000 figure came from the July notice, whose enforcement is now suspended. The official eTA document list does not currently request insurance proof. An airline can still apply its own document checks, so verify close to departure.

4. Should I upload my insurance certificate with the eTA?

There is no insurance upload in the public required-document list checked on August 30. Submit only through the official portal and follow any new field or request shown there.

5. Is travel insurance still worth buying for Kenya?

Yes when the policy fits the route and activities. Medical treatment, evacuation, cancellation and safari exclusions matter even without a border mandate.

6. Who is exempt from Kenya's eTA?

Kenya publishes passport, residence, permit, transit and official-document exemptions with different stay limits. Check the exact live list rather than using a broad nationality headline.

7. Does a child need a separate Kenya eTA?

Yes if the child is not exempt. The official portal says infants and children need their own approval, although a family can submit through a group application.

8. How early should I apply for a Kenya eTA?

The usual processing estimate is three working days, but the government recommends applying at least two weeks before travel. Use the longer window.

9. What if I forgot one hotel on the application?

Do not submit a conflicting second application without guidance. Contact the official eTA support service with the reference number and corrected itinerary, then save its written instruction.

10. Can I use the same eTA after visiting Tanzania?

The checked official FAQ does not publish a universal answer. Ask the eTA service about the exact approval and route before leaving Kenya. A forum report cannot confirm another traveler's admission.

Sources and updates

The legal background came from the Social Health Insurance Act and regulation 70 on Kenya Law. The current suspension came from Kenyan court reporting published after the August order. The Ministry of Health document was used to show that implementation had faced earlier litigation, not to claim that its old technical framework is operating now.

The required documents, exemption groups, child treatment, normal processing estimate, recommended application window and fees came from the live Directorate of Immigration eTA pages checked on August 30. The absence of insurance from that list is a dated observation, not a promise that the portal will remain unchanged.

Insurance pages published before August 24 commonly say the USD 50,000 rule is in force. Court reports explain the pause but do not combine it with the current portal, exemption list, family applications, Tanzania re-entry uncertainty or a clean pre-departure decision.
